Mandatory labeling of cosmetics and household chemicals
In accordance with the Russian Government Resolution of 30.11.2024 No. 1681, the rules for mandatory labeling of certain types of cosmetic products and household chemicals have been approved. We will describe the deadlines and what will be subject to labeling in the article.
Terms and stages of mandatory labeling of cosmetics and household chemicals
• from March 1, 2025 — start of mandatory registration of participants in the labeling system;
• from May 1, 2025 — the first stage of labeling: mandatory labeling of cosmetic products and household chemicals in consumer packaging (EAEU HS codes: 3401, 3402 50 000 0, 3405 40 000 0 and OKPD2 codes: 20.41.3, 20.41.44, 20.42.19);
• from July 1, 2025 — the second stage of labeling: mandatory labeling of cosmetic products and household chemicals in consumer packaging (EAEU HS codes: 3305, 3307 (except 3307 41 000 0, 3307 90 000 1, 3307 90 000 2) and OKPD2 codes: 20.41.41, 20.42.16, 20.42.17, 20.42.19);
• from October 1, 2025 — the third stage of labeling: mandatory labeling of cosmetic products and household chemicals in consumer packaging (EAEU HS codes: 3304 (except 3304 99 000 0, which relates to perfumery and cosmetic products intended for hand hygiene, with an antimicrobial effect declared in the labeling of consumer packaging), 3306 (except code 3306 20 000 0) and OKPD2 codes: 20.42.12, 20.42.13, 20.42.14 (except code 20.42.14.120), 20.42.15 (except for perfumery and cosmetic products intended for hand hygiene, with an antimicrobial effect declared in the labeling of consumer packaging), 20.42.18 (except for code 20.42.18.130);
• from July 1, 2026 — the obligation to transfer information on the withdrawal of goods from circulation at all stages through retail sale using cash registers appears;
• from July 1, 2026 to June 30, 2028 (inclusive) — the obligation to transfer information on turnover, as well as on the withdrawal of goods from circulation on grounds other than retail sale for all participants in the turnover, in volumetric and sorted accounting occurs (information on the product code (GTIN) and the quantity of marked goods should be indicated). From this date, all participants in the turnover must use electronic document management (EDM) during shipment and acceptance;
• from July 1, 2028 — full traceability of goods (item-by-item accounting) is introduced. From this date, all participants in the turnover must transfer information on each unit of marked goods (on a specific marking code) to the marking system during the turnover of goods, as well as when withdrawing goods from circulation for reasons other than retail sale. Goods produced before the transition to individual item accounting are circulated in volumetric and grade accounting.
What is not subject to labeling?
• goods placed under customs procedures for the purpose of export outside the territories of the EAEU;
• goods imported or produced as advertising, marketing samples, not intended for sale and having appropriate markings;
• goods with a volume of up to 5 milliliters or a weight of up to 5 grams inclusive, with the exception of goods related to the code of the commodity nomenclature 3304 and the classifier code 20.42.12;
• goods acquired under a transaction, information about which constitutes a state secret, as well as goods purchased in the manner prescribed by Part 11 of Article 24 of the Federal Law “On the contract system in the sphere of procurement of goods, works, services to meet state and municipal needs” or Article 3.5 of the Federal Law “On procurement goods, works, services by certain types of legal entities” when they are transported by a participant in such a transaction across the territory of the Russian Federation;
• goods packaged in retail organizations in the presence of the consumer;
• goods related to the code of the commodity nomenclature 3304 and to the code of the classifier 20.42.12, of cylindrical or conical shape with a diameter of the primary packaging less than 10 millimeters inclusive, and without secondary packaging that increases the total area of the consumer packaging.
